REL:mb(15) <br />7/8/88 <br /> <br />353 <br /> <br />RESOLUTION NO. 88-55 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />88-6 TO ALLOW FOUR WALL SIGNS IN EXCESS <br />OF SIZE LIMITATIONS ON ONE SIDE OF A <br />BUILDING LOCATED AT 305 EAST FOURTH STREET <br /> <br /> WHEREAS, this Council held a public hearing on <br />July 5, 1988, on Variance application No. 88-6 to allow four <br />wall signs in excess of size limitations on one side of a <br />building located at 305 East Fourth Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The building is a theater having a special <br />need for a marquee sign in addition to a theater name sign. <br />It is located in the Fiesta Marketplace theme development <br />and has special needs for additional identification signs <br />addressing pedestrian traffic on Fourth Street. Thus, the <br />str4et application of the zoning regulations would deprive <br />the subject property of privileges not otherwise at variance <br />with the purpose and intent of such regulations. <br /> <br /> (b) The granting of this variance is necessary to <br />allow the subject property to operate effectively as a <br />theater, which is a substantial property right. <br /> <br /> (c) The theater signage allowed by this variance <br />is compatible with the pedestrian marketplace theme of Fiesta <br />Marketplace and, therefore, will not be detrimental to the <br />public welfare or injurious to surrounding property. <br /> <br /> (d) <br />which would be <br />variance. <br /> <br />There are no provisions in the general plan <br />adversely affected by the granting of this <br /> <br /> 2.
