357 <br /> <br />REL:mb(15) <br />7/8/88 <br /> <br />RESOLUTION NO. 88-56 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />88-7 TO ALLOW CABINET SIGNS, WALL OR <br />CANOPY SIGNS FOR SECOND FLOOR RETAIL BUSI- <br />NESSES, AND USE OF NINE COLORS IN THE <br />SIGNAGE PROGRAM, FOR THE FIESTA MARKET- <br />PLACE DEVELOPMENT <br /> <br /> WHEREAS, this Council held a public hearing on <br />July 5, 1988, on Variance Application No. 88-7 to allow <br />cabinet signs, wall or canopy signs for second floor retail <br />businesses, and the use of nine colors in the signage pro- <br />gram, for the "Fiesta Marketplace" development located as <br />shown on Exhibit A, attached hereto and incorporated herein; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) "Fiesta Marketplace" is a unique development <br />having special signage needs. It will have second story retail <br />uses having access from second story walkways. Such businesses <br />need their own identification. It is designed as a pedestrian <br />marketplace and entertainment area needing more colorful and <br />varied signage than other commercial areas. Thus, the str~ict <br />application of the zoning regulations would deprive the subject <br />property of privileges not otherwise at variance with the purpose <br />and intent of such regulations. <br /> <br /> (b) The granting of this variance is necessary to <br />allow the subject property to operate effectively as a pede- <br />strian-oriented marketplace and entertainment area, which is <br />a substantial property right. <br /> <br /> (c) <br />be detrimental <br />ing properties. <br /> <br />The signage allowed by this variance will not <br />to the public welfare or injurious to surround- <br /> <br /> (d) <br />which would be <br />variance. <br /> <br />There are no provisions in the general plan <br />adversely affected by the granting of this <br /> <br /> 2. Variance No. 88-7 is hereby approved subject to the <br />following conditions: <br /> <br /> (a) Ail signs shall be reviewed by the planning <br />department prior to installation to assure compliance with <br />approved sign program for the subject property. <br /> <br />the <br /> <br /> <br />
