REL:mb(30) <br />6/7/89 <br /> <br />249 <br /> <br />RESOLUTION NO. 89- ~2 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING CON- <br />DITIONAL USE PERMIT NO. 88-5 TO ALLOW <br />SALE OF BEER AND WINE FOR OFF-SITE <br />CONSUMPTION AT A GROCERY STORE LOCATED <br />AT 1900 SOUTH MAIN STREET. <br /> <br /> WHEREAS, Conditional Use Permit Application No. 88-5, <br />to allow sale of beer and wine for off-site consumption at a <br />grocery store located at 1900 South Main Street, was denied by <br />the Planning Commission on January 23, 1989; and <br /> <br /> WHEREAS, on February 6, 1989 the City Council set <br />Conditional Use Permit Application No. 88-5 for public hearing <br />pursuant to section 41-645.5(b) of the Santa Ana Municipal Code, <br />thereby vacating the decision of the Planning Commission; and <br /> <br /> WHEREAS, on March 20, 1989 the City Council held a <br />public hearing on Conditional Use Permit Application No. 88-5; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid hear- <br />ing, the City Council finds and determines as follows: <br /> <br />(a) <br /> <br />The sale of beer and wine in the grocery store <br />on the subject property incidental to general <br />food sales will be a convenience to neighborhood <br />shoppers. <br /> <br />(b) <br /> <br />The sale of beer and wine at the grocery store <br />will be limited to a small portion of total sales. <br />Therefore, it will not be a blighting influence <br />on the area in which it is located. <br /> <br />(c) <br /> <br />For the foregoing reasons, the sale of beer and <br />wine at the grocery store on the subject property <br />provides a service which contributes to the <br />general well-being of the neighborhood. <br /> <br />(d) <br /> <br />Under the foregoing circumstances, such use will <br />not be detrimental to the health, safety, or general <br />welfare of persons residing or working in the <br />vicinity. <br /> <br />(e) <br /> <br />Such use will not adversely affect the present <br />economic stability or future economic development <br />of property in the surrounding area. <br /> <br /> <br />
