6/05/89 <br /> <br />RESOLUTION NO. 89-52 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA SETTING PARK ACQUISI- <br />TION AND DEVELOPMENT FEES <br /> <br /> WHEREAS, sections 35-108 through 35-114 of the Santa <br />Ana Municipal Code ("SAMC") establishes the authority for the <br />City to establish fees on residential development to pay for <br />the acquisition, construction, and renovation of park and <br />recreation facilities; and <br /> <br /> WHEREAS, the City Council does now find it necessary <br />to increase such park acquisition and development fees; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Pursuant to SAMC section 35-110, any person <br />adding net residential units shall pay a fee for each such net <br />residential unit based upon the number of bedrooms therein, <br />in accordance with the following schedule: <br /> <br />Bedrooms Fee <br /> <br />5 or more $2,640.00 <br />4 $2,385.00 <br />3 $2,140.00 <br />2 $1,600.00 <br />1 or less $1,200.00 <br /> <br /> b. Any person converting apartments to condominiums <br />shall pay a fee in an amount which is equivalent to the fee for <br />such condominiums as net residential units, less an amount equal <br />to the total fees paid under SAMC sections 35-108 through 35-114 <br />for the same residential units at the time of construction as <br />apartments. <br /> <br /> 2. In accordance with SAMC section 35-110, the pur- <br />pose of the abovesaid fee is to preserve an appropriate balance <br />between demand by residents for use of park and recreational <br />facilities and the availability of such park and recreational <br />facilities and to preclude residential development which would <br />create an excess demand on such facilities. <br /> <br /> 3. In accordance with SAMC section 35-108, the use <br />to which the abovesaid fee will be put is the acquisition, con- <br />struction and renovation of park and recreation facilities. <br />The public facilities to be financed by the fee are identified <br />in Exhibit A, attached hereto and incorported herein. <br /> <br /> <br />
