395 <br /> <br />REL:mb(18) <br />7/21/89 <br /> <br />RESOLUTION NO. 89-074 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING MINOR <br />EXCEPTION NO. 89-1 TO ALLOW A SIX-FOOT <br />HIGH FENCE WITHIN THE FRONT YARD SET- <br />BACK ON PROPERTY LOCATED AT 2009 WEST <br />ST. ANNE PLACE IN THE R1 DISTRICT. <br /> <br /> WHEREAS, this Council held a public hearing on July 17, <br />1989, on Minor Exception Application No. 89-1, to allow a six- <br />foot high fence within the front yard setback on property located <br />at 2009 West St. Anne Place in the R1 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submittd at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br />(a) <br /> <br />Because of special circumstances applicable to <br />the subject property, including size, shape, <br />topography, location or surroundings, the strict <br />application of the zoning ordinance is found to <br />deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose <br />of the provisions of this chapter. <br /> <br />(b) <br /> <br />The granting of a minor exception is necessary <br />for the preservation and enjoyment of one or <br />more substantial property rights. <br /> <br />(c) <br /> <br />The Granting of a minor exception will not be <br />materially detrimental to the public welfare or <br />injurious to surrounding property. <br /> <br />(d) The granting of a minor exception will not ad- <br /> versely affect the General Plan. <br /> <br /> <br />
