RESOLUTION NO. 89- 078 <br /> <br />A RESOLUTION OF THE CITY COJNCIL OF THE CITY OF SANTA ANA <br />ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 27 <br /> <br />'403 <br /> <br /> WHEREAS, by Minute Order dated June 19, 1989, a public hearing was <br />called for August 7, 1989, at the hour of 7:30 p.m., at the Council Cham- <br />bers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to <br />ascertain whether the public necessity, health, safety, or welfare required <br />the r~oval of poles, overhead wires and associated overhead structures, <br />and the underground installation of wires and facilities for supplying <br />electrical con~unication or similar or associated service, for the forma- <br />tion of the Underground Utility District No. 27 within that certain area of <br />the City described as follows: <br /> <br />The area bounded easterly and westerly by lines 100 feet frc~ the <br />centerline of Harbor Boulevard, northerly by a line 100 feet south <br />of centerline of Hazard Avenue, and southerly by the nutual boundary <br />of the Cities of Santa Ana and Fountain Valley. <br /> <br /> WHEREAS, notice of such hearing has been given to all affected prop- <br />erty owners as such are shown on the last equalized assessment roll and to <br />all utilities concerned in the manner and within the tin~ required by law; <br />end <br /> <br /> WHEREAS, such hearing has been duly and regularly held, and all per- <br />sons interested have been given an opportunity to be heard; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Santa Ana: <br /> <br /> 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to <br />37-13, the above-described area is hereby declared an Underground Utility <br />District and is designated as Underground Utility District No. 27 of the <br />City of Santa Aua. Attached hereto, marked Exhibit "A", and hereby incor- <br />porated as a part of this Resolution, is a map delineating the boundaries <br />of said District. <br /> <br /> 2. That the City Council does hereby fix June 1991 as the date on <br />which affected property owners must be ready to receive underground ser- <br />vice, and does hereby order the r~val of all poles, overhead wires and <br />associated overhead structures, and the underground installation of wires <br />and facilities for supplying electric, c~L,~zication, or similar or associ- <br />ated service within Underground Utility District No. 27 on or before <br />June 1, 1992. <br /> <br /> 3. This resolutic~ does not apply to overhead wires and associated <br />overhead structures crossing Harbor Boulevard at First and Fifth Streets, <br />pursuant to Santa Ana Municipal Code Section 37-7. <br /> <br /> 4. That the Clerk of the Council is hereby instructed to notify all <br />affected utilities and all affected property owners within Underground <br />Utility District 27 of the adoption of this Resolution within ten (10) days <br /> <br /> <br />
