027 <br /> <br />REL:mb(33) <br />8/9/89 <br />Rev. 9/20/89 <br /> <br />RESOLUTION NO. 89-~5 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE CITY OF SANTA ANA APPROVING VARI- <br /> ANCE NO. 89-9 TO ALLOW AN ELECTRONIC <br /> READER-BOARD SIGN AT 1430 VILLAGE WAY. <br /> <br /> ~-'~.~S~~uncil held a public hearing on September <br />18, 1%89 ~n)V~-~iaW6e-A~ication No. 89-9 to permit an electronic <br />reader%-bo~a~d sign on property located at 1430 Village Way which <br />application came before this Council as appeal number 89-4 follow- <br />ing its denial by the Planning Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid hear- <br />ing, this Council finds and determines as follows: <br /> <br /> a. Without the requested sign, the multiple tenants <br />in the subject building would be at a disadvantage in advertising <br />their businesses. Tenants having freeway exposure would have an <br />advantage over the others. <br /> <br /> b. Granting the requested sign will discourage banners, <br />balloons and other such advertising devices. <br /> <br /> c. Granting the requested sign will encourage invest- <br />ment in, and promote the success of, the subject business center. <br /> <br /> d. Because of special circumstance applicable to the <br />subject property, the strict application of the zoning ordinances <br />would deprive the property of privileges not at variance with the <br />intent and purpose of the zoning ordinances. <br /> <br /> e. The granting of this variance is necessary for the <br />presentation and enjoyment of one or more substantial property <br />rights. <br /> <br /> f. The granting of this variance will not be materi- <br />ally detrimental to the public welfare or injurious to surround- <br />ing property. <br /> <br /> g. The granting of this variance will not adversely <br />affect the General Business District land use designation for the <br />area established by the General Plan of the City. <br /> <br /> <br />
