113 <br /> <br />REL:mb(3~) <br />10/17/89 <br /> <br />RESOLUTION NO. 89-107 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING VARI- <br />ANCE NO. 89-16 TO ALLOW AN ILLUMINATED <br />WALL SIGN ON A BUILDING LOCATED AT 115 <br />WEST FOURTH STREET <br /> <br /> WHEREAS, this Council held a public hearing on October <br />16, 1989 on Variance Application No. 89-16 to permit an illuminated <br />wall sign on a building located at 115 West Fourth Street which <br />application came before this Council as appeal number 89-7 follow- <br />ing its denial by the Planning Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid hear- <br />ing, this Council finds and determines as follows: <br /> <br /> a. Because of special circumstance applicable to the <br />subject property, the strict application of the zoning ordinances <br />would deprive the property of privileges not at variance with the <br />intent and purpose of the zoning ordinances. <br /> <br /> b. The granting of this variance is necessary for the <br />presentation and enjoyment of one or more substantial property <br />rights. <br /> <br /> c. The granting of this variance will not be materi- <br />ally detrimental to the public welfare or injurious to surround- <br />ing property. <br /> <br /> d. The granting of this variance will not adversely <br />affect the District Center land use designation for the area <br /> <br /> <br />
