181 <br /> <br />RESOLUTION NO. 89-122 <br /> <br />REL:mb(7) <br />11/27/89 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING CONDITIONAL USE <br />PERMIT APPLICATION NO. 89-14 TO ALLOW THE <br />SALE OF ALCOHOLIC BEVERAGES IN A MARKET AT <br />1310 WEST THIRD STREET. <br /> <br /> WHEREAS, the City Council held a public hearing on <br />November 20, 1989 on Conditional Use Permit No. 89-14 to allow <br />the sale of alcoholic beverages in a market on property located <br />at 1310 West Third Street, which application was brought before <br />this Council on the Council's own decision following its denial <br />by the Planning Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br />(a) <br /> <br />Within 1,000 feet of the proposed site, there <br />exist nine separate ABC licenses. In addition <br />to the concentration of liquor licenses, the <br />grid reports an incidence of crime which ranks <br />it 34th of 102 reporting districts. The <br />introduction of additional establishment selling <br />alcoholic beverages could have a negative effect <br />on the general welfare of persons attending the <br />daycare facility located adjacent to the proposed <br />site, residing or working or in this area by <br />increasing problems associated with such uses. <br /> <br />(b) <br /> <br />The sale of alcoholic beverages from the grocery <br />market will be detrimental to the health, safety, <br />or general welfare of persons residing or working <br />in the local area. The market sales of alcoholic <br />beverages constitutes an over concentration of <br />alcoholic beverages sales in the area since <br />there are seven existing off-sale establishments <br />sited within 1000 feet. <br /> <br />(c) <br /> <br />The proposed use could affect the economic develop- <br />ment of property in this area by contributing to <br />social problems in the vicinity. In addition, <br />the above average crime conditions in the area <br />may be further aggravated by the addition of <br />another beer and wine license. <br /> <br /> <br />
