RESOLUTION NO. 90-065 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA INCREASING SEWER <br />CONNECTION FEES <br /> <br /> WHEREAS, section 39-53 of the Santa Ana Municipal Code ("SAMC") <br />requires payment of a fee for sewer connections to pay for the cost of sewer <br />construction; and <br /> <br /> WHEREAS, said SAMC section 39-53 provides that the amount of the <br />fee is based on an assessment per fixture units, except that in the case of <br />parcels not previously connected to a public sewer the fee for the first <br />occupancy unit benefitted by the sewer connection is based upon the standard <br />cost of construction of a sewer main for a distance equal to the lineal street <br />frontage of the subject parcel; and <br /> <br /> WHEREAS, in accordance with SAMC section 39-53, the assessment per <br />fixture unit and the standard cost of sewer construction per lineal foot of <br />street frontage is to be specified by resolution of the City Council; and <br /> <br /> WHEREAS, the City Council does now desire to increase the sewer <br />connection fee; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br /> <br /> 1. For purposes of SAMC section 39-53, the assessment per fixture <br />unit is set at $48.00. <br /> <br /> 2. The purpose of the fee is to provide for sewers to meet the <br />sanitation needs of the owners and occupants of property in the City. <br /> <br /> 3. The use to which the above said Fee will be put is the <br />construction, or reimbursement for construction, of sewers. The public <br />facilities to be financed by the Fee are identified in Exhibit A, attached <br />hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development projects, <br />including residential, commercial, office and industrial, which require <br />connection to the public sewer system. The use of the fee for sewers and the <br />need for such facilities is reasonably related to all types of development <br />projects because all such development projects generate sewage and require the <br />protection from sewerage provided by sewers. <br /> <br /> <br />
