199 <br /> <br />RESOLUTION NO. 90q]67 <br />PAGE TWO <br /> <br /> 2. In accordance with SAMC section 34-191, the purpose of the <br />drainage area fee is to provide for drainage facilities required to meet the <br />drainage needs created by subdivision or other development of properties <br />within local drainage areas which increase storm water runoff by coverage of <br />absorption areas and increase demand for protection from storm waters. <br /> <br /> 3. In accordance with SAMC section 34-192, the use to which the <br />abovesaid fee will be put is the construction, or reimbursement for <br />construction, of drainage facilities within the local drainage area from which <br />the fee was collected. The public facilities to be financed by the fee are <br />identified in Exhibit A, attached hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development projects, <br />including residential, commercial, office, and industrial, which will increase <br />storm water runoff by coverage of absorption areas and increase demand for <br />protection from storm waters. The use of the fee for drainage facilities and <br />the need for such facilities is reasonably related to all types of development <br />projects which have such effects because all such development projects <br />generate storm water run-off or receive the benefit of protection from storm <br />waters provided by such facilities. The restriction of the use of fees to <br />drainage facilities which are within the local drainage areas from which the <br />fees are derived assures that the fees derived from any 9iven development <br />project are used to provide those drainage improvements which most directly <br />address the needs created by such development project. <br /> <br /> 5. As used hereinafter "project" means proposed construction <br />activity which is subject to the payment of a drainage area fee under SAMC <br />sections 34-191 through 34-195 and as to which construction pursuant to a <br />validly issued building permit has not commenced as of the date of adoption of <br />this resolution. <br /> <br /> 6. All previous resolutions of the City Council establishing or <br />increasin9 drainage area fees are superseded by this resolution, and fees <br />established by this resolution shall apply to all projects except as otherwise <br />hereinafter provided. <br /> <br /> <br />
