RESOLUTION NO. 91-010 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />SPECIFYING THE PROCESS FOR APPROVING AND SITING IN ORANGE <br />COUNTY SOLID WASTE FACILITIES REUSING OR RECYCLING LESS THAN <br />15% OF MATERIAL RECEIVED AND SERVING MORE THAN ONE <br />JURISDICTION <br /> <br /> WHEREAS, AB 2296 requires that on or before February 1, 1991, <br />each county and majority of the cities containing the majority of <br />the population in the incorporated area in the county, must adopt <br />a resolution concerning the approval and siting of solid waste <br />facilities, not identified in a previously approved County Solid <br />Waste Management Plan, which are designed to recover or reuse less <br />than 15% of the material received; and <br /> <br /> WHEREAS, the Orange County Local Task Force is charged with <br />ensuring a coordinated and cost-effective regional recycling <br />system, pursuant to AB 939, Article 2, Section 40950; and <br /> <br /> WHEREAS, the Local Task Force can assist the recycling <br />activities of the cities by ensuring that solid waste facilities <br />maximize the recycling of material received within and beyond local <br />jurisdictions; and <br /> <br /> WHEREAS, recycling, the second priority of the AB 939 Source <br />Reduction and Recycling hierarchy, can be accomplished efficiently <br />only if recyclable materials are recovered and reused at all points <br />of entry; and <br /> <br /> WHEREAS, solid waste reduction within the County of Orange <br />must be a comprehensive endeavor, requiring both private and public <br />sector cooperation and conformity with all local, state, and <br />regional laws and regulations. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of the <br />City of Santa Ana specifies that the following process be <br />established for approval and siting of solid waste facilities <br />during the AB 939 "gap" that have not been identified in the <br />previously approved County Solid Waste Management Plan: <br /> <br />A. Any individual or entity that proposes to develop a solid <br />waste facility in the County of Orange that recovers or reuses <br />less than 15% of the material received and serves more than <br />one jurisdiction shall be subject to an approval process <br />requiring vote by the County of Orange and a majority of the <br />cities containing a majority of the incorporated population <br />in the county. <br /> <br /> <br />
