327 REL:mb 2/14/91 RESOLUTION NO. 91-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 28. WHEREAS, by Minute Order dated February 4, 1991, a public hearing was called for March 4, 1991, at the hour of 7:30 p.m., at the Council Chambers of the city Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electrical communication or similar or associated service, for the formation of the Underground Utility District No. 28 within that certain area of the City described as follows: That portion of the area within the Santa Ana City Limits bounded northerly and southerly by lines 85 feet from the centerline of Westminster Avenue, westerly by the centerline of Euclid Avenue, and easterly by the centerline of Fairview Street. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the above-described area is hereby declared an Underground Utility District and is designated as Underground Utility District No. 28 of the City of Santa Ana. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That the City Council does hereby fix December 1, 1992 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 28 on or before June 15, 1993. 3. That the City's Rule 20A Allocation will be charged for installing up to 100 feet of each customer's service lateral.
