181 <br /> <br />REL: 6/17/91 <br /> <br />RESOLUTION NO. 91- 063 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING A SITE LEASE <br />BY AND BETWEEN THE CITY OF SANTA ANA AND <br />THE ORANGE COUNTY PUBLIC FACILITIES <br />CORPORATION AND AUTHORIZING CERTAIN <br />ACTIONS IN CONNECTION THEREWITH <br /> <br /> WHEREAS, the Orange County Public Facilities Corporation (the <br />"Corporation") is a nonprofit public benefit corporation organized <br />and existing under the laws of the State of California with the <br />authority to assist the County of Orange (the "County") in the <br />financing of public facilities; and <br /> <br /> WHEREAS, the City of Santa Ana (the "City") and the <br />Corporation have entered into a Site Lease, dated as of December 1, <br />1987, between the City and the Corporation (the "1987 Site Lease") <br />pursuant to which the city has leased certain property (the "City <br />Property") to the Corporation; <br /> <br /> WHEREAS, The County of Orange, California, Certificates of <br />Participation, Series 1987 (civic Center Parking Facilities <br />Projects) (the "1987 Certificates") will no longer be outstanding <br />on or about August 1, 1991; and <br /> <br /> WHEREAS, pursuant to the terms of the 1987 Site Lease, the <br />1987 Site Lease will terminate at such time as the 1987 <br />certificates are no longer outstanding; and <br /> <br /> WHEREAS, it has been proposed that the City lease the City <br />Property and the improvements thereon to the Corporation pursuant <br />to a Site Lease, dated as of July 1, 1991, by and between the City <br />and the Corporation (the "city Site Lease"), which will grant to <br />the Corporation the right to the use and occupancy of the City <br />Property and the improvements thereon for a term not to exceed 55 <br />years, the form of which City Site Lease has been provided to this <br />City Council; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> SECTION 1. The City Site Lease presented at this meeting is <br />approved. The Mayor or his designee is authorized and directed for <br />and in the name of the City to execute said agreement. The Mayor or <br />his designee is hereby authorized and directed to execute, <br />acknowledge and deliver any and all documents and do any and all <br />things which they may deem necessary or advisable to consummate the <br />transactions contemplated by the City Site Lease and this <br />Resolution.
