Resolution No. 91- 064 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />AMENDING RESOLUTION NO. 82-110 TO PROVIDE FOR FEDERAL <br />GOVERNMENT MANDATED RETIREMENT BENEFIT FOR PART-TIME, <br />TEMPORARY AND EMERGENCY CLASSES OF EMPLOYMENT CONTAINED <br />IN THE CITY'S BASIC CLASSIFICATION AND COMPENSATION PLAN <br /> <br /> WHEREAS, on August 2, 1982, the City Council passed and <br />adopted Resolution No. 82-110 revising and re-establishing the <br />Basic Classification and Compensation Plan for Officers and <br />Employees of the City of Santa Ana; and <br /> <br /> WHEREAS, Section 1004, Article X of the City Charter of the <br />City of Santa Aha requires the City Manager to prepare, install and <br />maintain a position classification and pay plan subject to civil <br />service rules and regulations and the approval of the City Council; <br />and <br /> <br /> WHEREAS, City Council has from time to time amended said <br />Resolution; and <br /> <br /> WHEREAS, Federal Government through adoption of Omnibus Budget <br />Reconciliation Act of 1990 has mandated that all part-time, <br />temporary and emergency employees not covered by an existing <br />retirement system be covered by Social Security or other qualified <br />retirement plan; and <br /> <br /> WHEREAS, the city staff has evaluated all options and now <br />recommends that all eligible employees be covered by a qualified <br />retirement plan such as a Section 457 Deferred Compensation Plan <br />with a required total contribution of 7.5% of employee wages; and <br /> <br /> WHEREAS, the City has met and conferred with SEIU and has <br />reached an agreement whereby represented part-time employees will <br />contribute 3.75% of their wages into a qualified retirement plan <br />and the city will match their contribution by depositing 3.75% in <br />employee's retirement account; and <br /> <br /> WHEREAS, it is now desired to provide for a similar benefit to <br />the eligible part-time, temporary and emergency employees who are <br />not represented by the Union (SEIU). <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA: <br /> <br /> 1. That Resolution No. 82-110, as amended, is hereby further <br />amended by adding in proper numerical sequence a new Section 3.6 to <br />provide for the following federally mandated retirement benefits to <br />all unrepresented eligible part-time, temporary and emergency <br />employees as set forth below: <br /> <br /> <br />
