I29 <br /> <br />REL: 2/4/92 <br /> <br />RESOLUTION NO. 92-012 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING VARIANCE <br />APPLICATION NO. 91-005, W~ICH SOUGHT TO <br />ALLOW ANOFF-PREMISE ADVERTISING SIGN TO <br />BE MAINTAINED AT VARIANCE WITH THE OFF- <br />PREMISE SIGN REGULATIONS AT 225 SOUTH <br />GRAND AVENUE <br /> <br /> W~EREAS, this Council held a public hearing on February 3, <br />1992, on Variance Application No. 91-005, which sought to allow <br />relief from the City's off-premise advertising sign regulations and <br />nonconforming use regulations for property located at 225 South <br />Grand Avenue. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. The strict application of the zoning regulations will not <br />deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />chapter; <br /> <br />The existing building on the site may be maintained as a <br />legal nonconforming use and provides the owner of the <br />property with a viable economic use of that property. <br />The subject sign is not necessary to the owner's economic <br />use of the site. <br /> <br />B. That the granting of a variance is not necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights; <br /> <br />The existing building on the site may be maintained as a <br />legal nonconforming use and provides the owner of the <br />property with a viable economic use of that property. <br />The subject sign is not necessary to the owner's economic <br />use of the site. <br /> <br />C. That the granting of a variance will be injurious to <br />surrounding property; <br /> <br />The subject sign is one of five within a limited area. <br />The granting of a variance for the subject sign would <br />perpetuate off-premise advertising sign clutter within <br />that area and sustain the unsightly appearance and <br /> <br /> <br />
