2O5 <br /> <br />REL: 3/19/9~ <br /> <br />RESOLUTION NO. 92- 028 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING CONDITIONAL <br />U~E PEP~MIT APPLICATION NO. 91-011, WHICH <br />SOUGHT TO ALLOW A RECREATIONAL AND <br />ENTERTAINMENT USE OF PROPERTY LOCATED AT <br />2101 EAST EDINGER AVENUE <br /> <br /> WHEREAS, this Council held a public hearing on March 16, 1992, <br />on Variance Application No. 91-011, which sought to allow a <br />recreational and entertainment use of property located at 2101 East <br />Edinger Avenue; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br />A. The proposed use will not provide any service or facility <br />which will contribute to the general well being of the <br />neighborhood or the community. <br /> <br />The existing restaurant/dance hall operation has shown <br />itself to be detrimental to the area in which it is <br />located by the high crime rate associated with it. There <br />is no good reason to think that its continued operation <br />will be significantly better in this regard. <br /> <br />B. The proposed use will, under the circumstances of the <br />particular case, be detrimental to the health, safety or <br />general welfare of persons residing or working in the <br />vicinity. <br /> <br />Because of the increasing criminal activity associated <br />with the subject business operation (a 93% increase <br />within the last calendar year), the use has been and will <br />continue to be a threat to the safety and welfare of <br />persons working in the area. <br /> <br />C. The proposed use will adversely affect the present <br />economic stability and future economic development of property <br />in the surrounding area. <br /> <br />The economic viability of the surrounding area has been <br />decreasing due directly to the increase in criminal <br />activity associated with the subject business operation. <br />Its continuation may drive successful businesses away <br />from the area. <br /> <br /> <br />
