RESOLUTION NO. 92- 055 <br />PAGE TWO <br /> <br /> 2. In accordance with SAMC section 34-191, the purpose <br />of the drainage area fee is to provide for drainage facilities <br />required to meet the drainage needs created by subdivision or other <br />development of properties within local drainage areas which <br />increase storm water runoff by coverage of absorption areas and <br />increase demand for protection from storm water. <br /> <br /> 3. In accordance with SAMC section 34-192, the use to <br />which the above said fee will be put is the construction, or <br />reimbursement for construction, of drainage facilities within the <br />local drainage area from which the fee was collected. The public <br />facilities to be financed by the fee are identified in Exhibit A, <br />attached hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development projects, <br />including residential, commercial, office and industrial, which <br />will increase storm water runoff by coverage of absorption areas <br />and increase demand for protection from storm waters. The use of <br />the fee for drainage facilities and the need for such facilities is <br />reasonably related to all types of development projects which have <br />such effects because all such development projects generate storm <br />water run-off or receive the benefit of protection from storm <br />waters provided by such facilities. The restriction of the use of <br />fees to drainage facilities which are within the local drainage <br />areas from which the fees are derived assures that the fees derived <br />from any given development project are used to provide those <br />drainage improvements which most directly address the needs created <br />by such development project. <br /> <br /> 5. As used hereinafter "project" means proposed <br />construction activity which is subject to the payment of a drainage <br />area fee under SAMC sections 34-191 through 34-195 and as to which <br />construction pursuant to a validly issued building permit has not <br />commenced as of the date of adoption of this resolution. <br /> <br /> 6. Ail previous resolutions of the city Council <br />establishing or increasing drainage area fees are superseded by <br />this resolution, and fees established by this resolution shall <br />apply to all projects except as otherwise hereinafter provided. <br /> <br /> 7. Any project for which a building permit has been <br />issued prior to the adoption of this resolution shall be subject to <br />the drainage area fee which applies to such project immediately <br /> <br /> <br />
