371 <br /> <br />RESOLUTION NO. 92- 059 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA SETTING PARK ACQUISI- <br />TION AND DEVELOPMENT FEES <br /> <br /> WHEREAS, sections 35-108 through 35-114 of the Santa Ana <br />Municipal Code ("SAMC") establishes the authority for the City to <br />establish fees on residential development to pay for the <br />acquisition, construction, and renovation of park and recreation <br />facilities; and <br /> <br /> WHEREAS, the City Council does now find it necessary to <br />increase such park acquisition and development fees; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. a. Pursuant to SAMC section 35-110, any person adding <br />net residential units shall pay a fee for each such net residential <br />unit based upon the number of bedrooms therein, in accordance with <br />the following schedule: <br /> <br />Bedrooms Fee <br /> <br />5 or more $3,060.00 <br />4 $2,750.00 <br />3 $2,485.00 <br />2 $1,850.00 <br />1 or less $1,390.00 <br /> <br /> b. Any person converting apartments to condominiums <br />shall pay a fee in an amount which is equivalent to the fee for <br />such condominiums as net residential units, less an amount equal to <br />the total fees paid under SAMC sections 35-108 through 35-114 for <br />the same residential units at the time of construction as <br />apartments. <br /> <br /> 2. In accordance with SAMC section 35-110, the purpose of <br />the abovesaid fee is to preserve an appropriate balance between <br />demand by residents for use of park and recreational facilities and <br />the availability of such park and recreational facilities and to <br />preclude residential development which would create an excess <br />demand on such facilities. <br /> <br /> 3. In accordance with SAMC section 35-108, the use to which <br />the abovesaid fee will be put is the acquisition, construction and <br />renovation of park and recreational facilities. The public <br />facilities to be financed by the fee are identified in Exhibit A, <br /> <br /> <br />
