PART 9 <br /> <br />PROJECT IMPLEMENTATION <br /> <br />91. Reportinq/Monitorinq Programs for Certain Projects ADproved on <br /> <br /> the Basis of a Mitigated NeGative Declaration. <br /> (a) This section applies to projects which meet the following <br /> <br />criteria: <br /> <br /> 1. The project is not entitled to any exemption under <br /> <br /> CEQA or the State CEQA Guidelines. <br /> <br /> 2. The project is not entitled to a negative declara- <br /> tion unless it is conditioned upon compliance with <br /> certain mitigation measures. <br /> <br /> 3. The mitigation measures which serve to justify the <br /> issuance of a negative declaration are of one of <br /> <br />the following types: <br /> <br /> "Type A": Compliance <br />the mitigation measure can <br /> <br />or noncompliance with <br />be ascertained in the <br /> <br />course of City review of plans submitted by the <br />project applicant pursuant to the development <br />project plan approval procedure (SAMC sections 41- <br /> <br />668 et seq.) or the "plan check" procedures under <br />the Building Code, or in the course of City review <br />of construction work undertaken in accordance with <br />such plans prior to final approval of such <br />construction by the City. <br /> <br /> "Type B": The mitigation measure is not Type <br /> <br />28 <br /> <br /> <br />
