Hubbard, Dale H. Heinly, <br /> Bob Brewer, A. A. Hall <br /> <br />Absent Councilmen <br /> <br />Report <br />City Attorney <br />Boundary C~mis- <br />sion findings <br />"Newport and Dyer <br />S. E. Annex" <br /> <br />Henry H. Schlueter <br /> <br /> The Attorney orally reported he and the Director of Public Works attended the <br /> Boundary Cus~Ission meeting held at ll:04 A. M., this date, and the Boundary Commis- <br /> sion found the boundaries of the proposed annexation of territory to the City, des~i <br /> ignated "Newport and Dyer S.E. Annex~' were not definite andcertain, due to the <br /> omission of a phrase in the legal description. ~ir. Foreman orally reported the <br /> portion cmitted was the book and page number reference the recording of the deed <br /> <br />for the right-of-way the State acquired for the San Diego Freeway. It was moved <br /> <br />by Councilman Heinly, seconded by Hubbard and carried, that the oral reports of the <br /> <br />Attorney and the Director of Public Works be accepted, and a copy of the boundary <br /> <br />description be corrected to show the course emitted and resubmitted to the Boundary <br /> <br />Cu~aission for their determination. Councilman Heinly stated the phrase left out <br /> <br />was not part of the legal description, but merely a reference to the recording of <br /> <br />C~-w, unication <br />Glenn E. Mathis, <br />et al, exclusion of <br />property "Newport <br />and Dyer S.E. Annex" <br /> <br />the instrument. <br /> <br />The Clerk presented and read a co,,,~nication signed by Glenn E. and Charlotte M. <br />Mathis, and First Western Bank and Trust Company, Trustee under its Trust No. lO0- <br />B/Mathis, consenting to the exclusion of the site of the residence dwelling, owned <br />and occupied by thom, from the reminder of the property, owned by thom, in fixing <br /> <br />the boundaries of the territory proposed to be annexed to the City; and stating <br /> <br />that the boundary lines drawn to exclude the site of their residence dwelling and <br /> <br />to include the remainder of the property owned by them, even though said dwelling <br /> <br />site is contiguous and adjacent to the remainder of their property, was drawn at <br /> <br />their consent. On motion of Councilman Heinly, seconded by Brewer and carried, the <br /> <br />Pet it ion <br />Ross W. Cortese, <br />et al, request <br />annexation "Newport <br />and Dyer S.E. Annex" <br /> <br />Protest <br />The Irvine Co. <br />"Newport and Dyer <br />S. E. Annex" <br /> <br />communication was received and filed. <br />" an individual, <br />The Clerk presented and read a petition signed by Ross W. Cortese~/and Ross W. Cor- <br /> <br />tese as President, and L. Fuglie as Assistant Secretary of Rossmoor Leisure World, <br />requesting annexation of territory to the City of Santa Ana designated "Newport and <br />Dyer S. E. Annex." On motion of Councilman Hubbard, seconded by Heinly and carried~ <br />the petition was received and filed. <br /> <br />A communication was presented and read by the Clerk, signed by Charles S. Thomas, <br />President, The Irvine Cd, party, advising The Irvine Company is unalterably opposed <br />to the proposed "Newport and Dyer S. E. Annex'~ as it is not in the best interests <br /> <br /> <br />
