STATEMENT OF COMPLIANCE WITH <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT, <br />FINDINGS OF FACT, AND STATEMENT OF OVERRIDING <br />CONSIDERATIONS FOR THE MAIN STREET CONCOURSE <br /> <br />I. INTRODUCTION <br /> <br />The Orient Corporation of America, Inc. ("Orient") as property <br />owner and Shimizu America Corporation ("Shimizu"), as project <br />proponent ("Orient" and "Shimizu" are collectively sometimes <br />referred to as the "Applicant" for purposes herein) propose to <br />develop a mixed-use project containing commercial <br />office/retail/hotel/residential uses and related incidental <br />function areas and parking facilities (the "Main Street Concourse" <br />development, more particularly described below). The proposed <br />development will be located on 18.9 acres of primarily vacant land <br />owned by Orient at the northeast corner of Main Street and Owens <br />Drive in the City of Santa Ana, California. <br /> <br />The environmental consequences of the Main Street Concourse were <br />evaluated and assessed in a "Revised Draft Environmental Impact <br />Report for Main Street Concourse" dated April 15, 1992 (the <br />"Revised Draft EIR"). <br /> <br />This Statement includes the environmental effects, including <br />significant effects, of the proposed Main Street Concourse <br />development, mitigation measures, findings with respect to <br />environmental effects, the rationale for the findings, and the <br />overriding considerations for the development. A separate <br />mitigation monitoring program has been prepared and adopted <br />concurrently with this Statement (the "Mitigation Monitoring <br />Program"). This Statement is not a new assessment of the <br />environmental effects which will result from the construction and <br />development of the Main Street Concourse, nor does it replace or <br />supersede any provisions of the Revised Draft EIR. This Statement <br />is merely a recompilation and extrapolation of data and information <br />contained in the revised draft EIR regarding the environmental <br />impacts and mitigation measures. The purpose of this Statement is <br />to bridge the analytic gap between the data and information <br />contained in the Revised Draft EIR and the findings required to be <br />made in accordance with the California Environmental Quality Act <br />("CEQA"). <br /> <br /> <br />
