RESOLUTION NO. 93- 094 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF TIlE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />93-005, TO ALLOW A REDUCTION IN MINIMUM <br />SETBACK AND TO ALLOW A FENCE EXCEEDING <br />}{EIGHT LIMITS IN THE SETBACK AREA FOR A <br />PROPOSED ENLARGEMENT OF AN AUTOMOBILE <br />REPAIR BUILDING LOCATED AT 2002 WEST <br />FIRST STREET <br /> <br /> WHEREAS, this Council held a public hearing on December 6, <br />1993, on Variance Application No. 93-005, to allow: <br /> <br />(i) <br /> <br />A reduction in minimum building setback standards from 15 <br />feet to 9 feet; and <br /> <br />An eight-foot high wrought iron fence within the setback <br />area. <br /> <br />for a proposed enlargement of an automobile repair building located <br />at 2002 West First Street; <br /> <br /> NOW, TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. Because of special circumstances applicable to the subject <br />property, the strict application of the minimum lot size and <br />minimum planter size requirements in the zoning regulations <br />would deprive the subject property of privileges not otherwise <br />at variance with the intent and purpose of the provisions of <br />this chapter; <br /> <br />Because of the triangular shape of the property and <br />adjacent land uses, the strict application of the 15 foot <br />setback and fencing requirements would require an unduly <br />large percentage of the property to be maintained as <br />landscaping and prevent effective security fencing. <br /> <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights; <br /> <br />The granting of the variance is necessary to allow proper <br />development of the site in accordance with the intent of <br />community development standards and to provide effective <br />protection from impacts associated with neighboring <br />uses. <br /> <br /> <br />
