219 <br /> <br />RESOLUTION NO. 94-002 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ESTABLISHING UNDERGROUND <br />UTILITY DISTRICT NO. 30. <br /> <br /> WHEREAS, by Minute Order dated November 15, 1993, a <br />public hearing was called for January 3, 1994, at the hour of 7:30 <br />p.m., at the Council Chambers of the City Hall, 22 Civic Center <br />Plaza, Santa Ana, California, to ascertain whether the public <br />necessity, health, safety, or welfare required the removal of <br />poles, overhead wires and associated overhead structures, and the <br />underground installation of wires and facilities for supplying <br />electrical communication or similar or associated service, for the <br />formation of the Underground Utility District No. 30 within that <br />certain area of the City described as follows: <br /> <br /> That portion of the area within the Santa <br />Ana city Limits bounded northerly by a line 50 <br />feet from the centerline of Civic Center <br />Drive, easterly by a line 50 feet from the <br />centerline of Ross Street, southerly by a line <br />50 feet from the centerline of 6th Street, and <br />westerly by a line 50 feet from the centerline <br />of Shelton Street. <br /> <br /> WHEREAS, notice of such hearing has been given to all <br />affected property owners as such are shown on the last equalized <br />assessment roll and to all utilities concerned in the manner and <br />within the time required by law; and <br /> <br /> WHEREAS, such hearing has been duly and regularly held, <br />and all persons interested have been given an opportunity to be <br />hears; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana: <br /> <br /> 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to <br />37-13, the above-described area is hereby declared an Underground <br />Utility District and is designated as Underground Utility District <br />No. 30 of the city of Santa ana. Attached hereto, marked Exhibit <br />"A", and hereby incorporated as a part of this Resolution, is a map <br />delineating the boundaries of said District. <br /> <br /> 2. That the City Council does hereby fix December 31, 1994 as <br />the date on which affected property owners must be ready to receive <br />underground service, and does hereby order the removal of all <br />poles, overhead wires and associated overhead structures, and the <br />underground installation of wires and facilities for supplying <br />electric, communication, or similar or associated service within <br />Underground Utility District No. 30 on or before March 1, 1995. <br /> <br /> <br />
