222 <br /> <br />RESOLUTION NO. 94-003 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AUTHORIZING PAYMENT OF PUNITIVE <br />DAMAGES IN CONNECTION WITH THE U.S. DISTRICT <br />COURT CASE ENTITLED SANTA ANA CITY EMPLOYEES <br />ASSOCIATION V. CITY OF SANTA ANA <br /> <br /> WHEREAS, the City of Santa Ana and various Santa Ana employees <br />have been sued in the United States District Court, Case No. CV-91- <br />0212-RMT(Ex), entitled Santa Ana City Employees Association, et <br />al., v. City of Santa Ana, et al.; and <br /> <br /> WHEREAS, the facts involving said lawsuit have been discussed <br />in executive session of the City Council on various occasions, <br />including January 3, 1994, held pursuant to Government Code <br />54956.9)a); and <br /> <br /> WHEREAS, the City Council desires to provide for payment by <br />the City of Santa Ana of any exemplary, or punitive damages, that <br />has been assessed against Library Director Rob Richard as a result <br />of said lawsuit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA FINDS AND DETERMINES AS FOLLOWS: <br /> <br /> 1. The Santa Ana Library Director named in the above <br />recitals was acting in the course and scope of his employment at <br />the time of the alleged wrongdoing; <br /> <br /> 2. At the time of the conduct, said Library Director acted <br />in good faith, without malice, and in the apparent best interests <br />of the City of Santa Ana; and <br /> <br /> <br />
