RESOLUTION NO. 94-0]5 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING VARIANCE <br />APPLICATION NO. 93-008, WHICH SOUGHT TO <br />ALLOW AN OFF-PREMISE ADVERTISING SIGN TO <br />BE MAINTAINED AT VARIANCE WITH THE OFF- <br />PREMISE SIGN REGULATIONS AT 3151 SOUTH <br />STANDARD AVENUE <br /> <br /> WHEREAS, this Council held a public hearing on March 7, 1994, <br />on Variance Application No. 93-008, which sought to allow relief <br />from the City's off-premise advertising sign regulations and <br />nonconforming use regulations for property located at 3151 South <br />Standard Avenue; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. The strict application of the zoning regulations will not <br />deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />chapter; <br /> <br />The subject property located at 3151 South Standard <br />Avenue is a flat, rectangularly shaped parcel with no <br />special circumstances related to its size, shape, <br />topography, location or surroundings. A viable use of <br />the land is available through the use of the structure <br />on-site. The property has not been deprived of any <br />privileges accorded any nearby properties as these <br />properties are also located in a Critical Development <br />Area and are governed by the same Off-Premise Commercial <br />Advertising Sign Ordinance. The strict application of <br />these codes would not deprive the subject property of <br />privileges securable to other property sites within the <br />area. <br /> <br />B. That the granting of a variance is not necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights; <br /> <br />The property owner's substantial property rights will <br />continue to be preserved and an adequate means of benefit <br />will remain available to him by the continued use of the <br />building on-site. <br /> <br />C. That the granting of a variance will be injurious to <br /> <br /> <br />
