RESOLUTION94-036 <br />Page 13 <br /> <br />REVENUE <br />ACCOUNT <br /> <br /> FIRE DEPARTMENT CONTINUED <br /> <br />DEPARTMENT/MISCELLANEOUS FEE OR SERVICE <br /> <br />UNIT <br /> <br />5546 ADMINISTRATIVE PENALTY FEE SCHEDULE <br /> <br /> This lee Schedule utilizes a base penalty tot each of the lis/ed offenses and assesses a surcharge to ti3at <br /> penally expressed as a percentage of Ihs base penally to~ those factors as outlined in H&S Code Section <br /> 25514.5(0 which include, but are not limiled to, the following consideralions, but shall not exceed $5,000 for <br /> each day the violation occurs: <br /> <br />059 <br /> <br />PROPOSED <br />FY 94-95 <br /> <br />a. Extent of harm caused by the violation - surcharge to 500 percent. <br />b. The natur~ and persistence of the violation .~ surcharge to 500 percent. <br />c. T~e length ol time over which the violation occurs-surcharge to 100 percent. <br />d. The frequency ot pasl violations - surcharge to 100 per'centL <br />e. Action taken to mitigale the violation - surcharge lo 100 percent. <br />I. Financial burden on the violator - will be considered. <br /> <br />The following base penalties shall be assessed for the belowTlisted violations: <br />1. H&S Code Section 25503,5 <br /> Failure to establish and Implement a business plan for <br /> emergency response. <br /> <br />2. H&S Code Section 25503.6 <br /> Failure to notify real property owner Ihat a business plan is <br /> required. <br />3. H&S Oode Section 25503.7 <br /> Failure to notify administering agency that hazardous substance <br /> is being stored in railroad car. <br /> <br />4. H&S Section 25503.8 <br /> Failure by t~usiness, which is required to submit chemical <br /> inventory pursuanl lo Federal Law, to establish and implement <br /> a business plan. <br /> <br />5. H&S Code Section 25504 <br /> Failure to provide a complete business plan. <br /> <br />6. H&S Code Section 25505 <br /> Failure to correct, revise, or review business plan. Failure to <br /> sumil annual inventory disclosure. <br /> <br />7. H&S Code Section 25509 <br /> Failure to provide complete inventopj disclosure <br /> <br />8.
