547 <br /> <br />REL: 5/19R5 <br /> <br />RESOLUTION NO. 95- 019 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA SETTING DRAINAGE AREA <br />FEES <br /> <br /> Wq{EREAS, pursuant to sections 34-191 through 34-194 of <br />the Santa Aha Municipal Code ("SAMC") the City Council of the City <br />of Santa Aha is authorized to establish fees by resolution to pay <br />for drainage facilities required to meet drainage needs created by <br />development; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. In the drainage areas of the City of Santa Aha, the <br />fees charged shall be as follows: <br /> <br />Drainage <br />Area Fee/Acre <br /> <br />I $4z60 <br />II $5015 <br />III $2700 <br />IV $3985 <br />V $4540 <br />VI $4465 <br /> <br /> 2. In accordance with SAMC section 34-191, the purpose <br />of the drainage area fee is to provide for drainage facilities <br />required to meet the drainage needs created by subdivision or other <br />development of properties within local drainage areas which <br />increase storm water runoff by coverage of absorption areas and <br />increase demand for protection from storm water. <br /> <br /> 3. In accordance with SAMC section 34-192, the use to <br />which the above said fee will be put is the construction, or <br />reimbursement for construction, of drainage facilities within the <br />local drainage area from which the fee was collected. The public <br />facilities to be financed by the fee are identified in Exhibit A, <br />attached hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development <br />projects, including residential, commercial, office and industrial, <br />which will increase storm water runoff by coverage of absorption <br />areas and increase demand for protection from storm waters. The <br />use of the fee for drainage facilities and the need for such <br />facilities is reasonably related to all types of development <br />projects which have such effects because all such development <br />projects generate storm water runoff or receive the benefit of <br /> <br />1 <br /> <br /> <br />
