RESOLUTION NO. 95-027 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING A CODE OF STANDARDS OF <br />CONDUCT FOR ITS VARIOUS EMPLOYEES, OFFICERS, <br />AND AGENTS FOR ITS COMMUNITY DEVELOPMENT BLOCK <br /> GRANT PROGRAM <br /> <br /> WHEREAS, the city of Santa Aha is the recipient of Community <br />Development Block Grant ("CDBG") funds from the United States <br />Department of Housing and Urban Development ("HUD") pursuant to <br />Title I of the Housing and Community Development Act of 1974, <br />Public Law 93-383, 42 U.S.C. S5301 et seq., as amended through <br />Public Law 103--233; and <br /> <br /> WHEREAS, pursuant to Title 24 of the Code of Federal <br />Regulations, Section 85.36(b)(3), regarding administrative <br />requirements for CDBG programs, HUD requires the city of Santa Ana <br />to maintain a written code of standards of conduct governing the <br />performance of its employees, officers, or agents engaged in the <br />award and/or administration of agreements concerning CDBG sub- <br />grants; <br /> <br /> WHEREAS, this proposed code of standards of conduct for the <br />city's various employees, officers, and agents of the CDBG program <br />has been submitted to the City Council for approval. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. No employee, officer, or agent of the city of Santa Aha <br />shall participate in the selection, award, or administration of a <br />contract on behalf of the City concerning a Community Development <br />Block Grant agreement if a conflict of interest, whether real or <br />apparent, would be involved. <br /> <br />2. Such a conflict of interest would arise when: <br /> <br />(a) The employee', officer, or agent, <br /> <br />(b) Any member of his or her immediate family, <br /> <br />(c) <br /> <br />(d) <br /> <br />His or her partner, or <br /> <br />Any organization which employs, or is about to <br />emPloy, any of the above, has a financial or <br />other interest in the sub-recipientselected for <br />the sub-grant. <br /> <br /> 3. The City's employees, officers, or agents are prohibited <br />from soliciting or accepting gratuities, favors, or anything of <br /> <br /> <br />
