RESOLUTION NO. 95- 071 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM UNDER THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991 WHEREAS, the City of Santa Ana, in cooperation with the State of california Department of Transportation, desires to enhance the landscape aesthetics along Interstate 5 in the City of Santa Ana in Orange County; and WHEREAS, the United States Congress has enacted the Intermodal Surface Transportation Efficiency Act of 1991, which is intended to provide over $200 million in federal funds over a six year period to local, state and federal agencies and nonprofit entities for projects to enhance and mitigate the environmental impacts of modified or new public transportation facilities; and WHEREAS, the State of California Department of Transportation and the Orange County Transportation Authority have established the procedures and criteria for reviewing grant proposals and are required to submit to the California Transportation Commission a list of recommended projects from which the grant recipients will be selected; and WHEREAS, said procedures and criteria established by the State of California Department of Transportation require a resolution certifying the approval of application by the applicant's governing body before submission of said application to the State of California Department of Transportation and the California Transportation Commission; and WHEREAS, the application contains assurances that the applicant must comply with; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the Transportation Enhancement Activities Project. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. Approves the filing of a joint application for Transportation Enhancement Activities Program grant assistance. 2. Certifies that the City of Santa Aha will make adequate provisions for operation and maintenance of the project. 3. Appoints James G. Ross, Executive Director of Public Works as agent of the city of Santa Ana to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project.
