RESOLUTION 96-035 <br /> <br />REVENUE <br />ACCOUNT <br /> <br />DEPARTMENT/MISCELLANEOUS FEE OR SERVICE UNIT <br /> <br />PROPOSED <br />FEES <br /> FY 96-97 <br /> <br />SECTION IV FIRE DEPARTMENT - CONTINUED <br /> <br />5546 <br /> <br />ADMINISTRATIVE PENALTY FEE SCHEDULE <br /> <br />This fee schedule utilizes a base penalty for each of the listed offenses and assesses a surcharge to that <br />penalty expressed as a percentage of the base penalty for those factors as outlined in H&S Code Section <br />25514.5(0 which include, but are not limited to, the following considerations, but shall not exceed $5,000 for <br />each day the violation occurs: <br /> <br />a. Extent of harm caused by the violation - surcharge to 500 percent. <br />b. The nature and persistence of the violation - surcharge to 500 percent. <br />c. The length of time over which the violation occurs-surcharge to 100 percent. <br />d. The frequency of past violations - surcharge to 100 percent. <br />e. Action taken to mitigate the violation - surcharge to 100 percent. <br />f. Financial burden on the violator - will be considered. <br /> <br />The following base penalties shall be assessed for the below-listed violations: <br />1. H&S Code Section 25503.5 <br /> Failure to establish and implement a business plan for <br /> emergency response. <br /> <br />266.00 <br /> <br />2. H&S Code Section 25503.6 <br /> Failure to notify real property owner that a business plan is <br /> required. <br /> <br />106.00 <br /> <br />3. H&S Code Section 25503.7 <br /> Failure to notify administering agency that hazardous substance <br /> is being slored in railroad car. <br /> <br />266.00 <br /> <br />4. H&S Section 25503.8 <br /> Failure by business, which is required to submit chemical <br /> inventory pursuant to Federal Law, to establish and implement <br /> a business plan. <br /> <br />266.00 <br /> <br />5. H&S Code Section 25504 <br /> Failure to provide a complete business plan. <br /> <br />160.00 <br /> <br />6. H&S Code Section 25505 <br /> Failure to correct, revise, or review business plan. Failure to <br /> submit annual inventory disclosure. <br /> <br />7. H&S Code Section 25509 <br /> Failure to provide complete inventory disclosure <br /> <br />160.00 <br /> <br />160.00 <br /> <br />8.
