RESOLUTION 97-001 003 <br /> <br />Variance No. 96-05 <br /> ~cember 16, 1996 <br />~age 1 <br /> <br />Findings <br /> <br />Special circumstances exist on this property, including size, shape, <br />topography, location or surroundings, where the strict application of <br />the zoning ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and purpose of <br />the provisions of this chapter. <br /> <br />The variances are a benefit to the developer and center as they <br />will increase the exposure and advertising for the development, <br />which is currently difficult due to the size and shape of the <br />property. This in turn will benefit the community. <br /> <br />The granting of a variance is necessary for the preservation and <br />enjoyment of one or more substantial property rights. <br /> <br />The requests are necessary to increase the visibility for <br />businesses in the proposed retail center. <br /> <br />The granting of a variance will not be materially detrimental to the <br />public welfare or injurious to surrounding property. <br /> <br />Approving the variances would not have a negative impact on the <br />surrounding property or the public in general. The retail <br />center will provide a benefit to the community. Mitigation <br />measures are being required where necessary and appropriate. <br /> <br />The granting of a variance will not adversely affect the general plan <br />of the city. <br /> <br />The variance will not have a negative effect on the General <br />Plan. <br /> <br />EXHIBIT A <br /> <br /> <br />
