057 <br /> <br />GAS: 4/15/97 <br /> <br />RESOLUTION NO. 97-016 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />97-02, TO PERMIT A 16 FOOT CELLULAR <br />ANTENNA TO BE MOUNTED ON AN EXISTING <br />BUILDING LOCATED AT 3620 SOUTH BRISTOL <br />STREET <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-638 provides for <br />the granting of a variance from the provisions of the Santa Ana <br />Municipal Code; <br /> <br /> WHEREAS, this Council held a public hearing on April 7, 1997, <br />on Variance Application No. 97-02, to permit a 16 foot cellular <br />antenna to be mounted on an existing building located at 3620 South <br />Bristol Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. Because of special circumstances applicable to the subject <br />property, the strict application of the 10 foot allowable <br />height requirement for roof mounted equipment in the zoning <br />regulations would deprive the subject property of privileges <br />not otherwise at variance with the intent and purpose of the <br />provisions of this chapter. <br /> <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights. <br /> <br />C. That the granting of a variance will not be materially <br />detrimental to the public welfare or injurious to surrounding <br />property in that the proposed roof mounted antenna is <br />consistent with the direction of the subcommittee created by <br />the Planning Commission to evaluate the city's policy <br />direction on cellular facilities. <br /> <br />D. That the granting of a variance will not adversely affect <br />the General Plan of the City in that the granting of this <br />variance will have no direct detrimental effect on the General <br />Plan. <br /> <br /> 2. Subject to the conditions set forth below, Variance No. <br />97-02 is hereby approved. <br /> <br /> <br />
