057 GAS: 4/15/97 RESOLUTION NO. 97-016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 97-02, TO PERMIT A 16 FOOT CELLULAR ANTENNA TO BE MOUNTED ON AN EXISTING BUILDING LOCATED AT 3620 SOUTH BRISTOL STREET WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code; WHEREAS, this Council held a public hearing on April 7, 1997, on Variance Application No. 97-02, to permit a 16 foot cellular antenna to be mounted on an existing building located at 3620 South Bristol Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: A. Because of special circumstances applicable to the subject property, the strict application of the 10 foot allowable height requirement for roof mounted equipment in the zoning regulations would deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property in that the proposed roof mounted antenna is consistent with the direction of the subcommittee created by the Planning Commission to evaluate the city's policy direction on cellular facilities. D. That the granting of a variance will not adversely affect the General Plan of the City in that the granting of this variance will have no direct detrimental effect on the General Plan. 2. Subject to the conditions set forth below, Variance No. 97-02 is hereby approved.
