RESOLUTION NO. 97- 018 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA SUMMARILY VA- <br />CATING AN UNIMPROVED EXCESS RIGHT- <br />OF-WAY PORTION OF ARNETT DRIVE. <br /> <br /> WHEREAS, this Council finds and determines that certain <br />portion of Arnett Drive lying west of the intersection with Main <br />Street, more specifically described hereinbelow, is excess right- <br />of-way not required for street purposes, for the following reasons: <br /> <br /> A. Realignment of the I-5 Santa Ana Freeway has resulted in <br />the remaining portion of Arnett Drive to be unimproved and no <br />longer required for street or highway purposes; <br /> <br /> B. The said portion of Arnett Drive lies within property <br />under one ownership, to wit, the Community Redevelopment Agency of <br />the City of Santa Ana, does not continue to through to any other <br />property and therefore is not necessary to provide access to <br />abutting property owners; and, <br /> <br /> WHEREAS, this Council finds and determines that there are no <br />in-place public utility facilities in the abovesaid portion of <br />Arnett Drive that are in use and would be affected by the vacation <br />of said portion of Arnett Drive; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Pursuant to the provisions of Chapter 4 of Part 33 of <br />Division 9 of the Streets and Highways Code of the State of <br />California, and, in particular, § 8334 thereof, that portion of <br />Arnett Drive in the City of Santa Ana lying west of Main Street is, <br />under the facts hereinabove recited, hereby summarily vacated and, <br />from the date this resolution is recorded in the office of the <br />Recorder of Orange County, shall no longer constitute a street or <br />any portion thereof. <br /> <br /> 2. The Clerk of the Council is hereby directed to cause a <br />certified copy hereof, attested by her under seal, to be recorded <br />in the office of the Recorder of Orange County, at such time as the <br />Clerk of the Council receives a written request from the Executive <br />Director of the Public Works Agency, and upon the conditions of <br />recordation of dedication or reservation of necessary easements for <br />right of way or public services. <br /> <br /> <br />
