101 <br /> <br />RESOLUTION NO. 97-020 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />97-03, TO ALLOW RELIEF FROM CERTAIN <br />PARKING, SETBACK, AND LANDSCAPING RE- <br />QUIREMENTS FOR THE DISCOVERY SCIENCE <br />CENTER LOCATED AT 2522 NORTH MAIN STREET <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-638 provides for <br />the granting of a variance from the provisions of the Santa Ana <br />Municipal Code; <br /> <br /> WHEREAS, this Council held a public hearing on April 21, 1997 <br />on Variance Application No. 97-03, to allow: <br /> <br />(1) A reduction in the passenger bus parking space require- <br /> ment from 22 spaces to five spaces. <br /> <br />(2) A waiver of the front yard, freeway, and creek area <br /> setback requirements; and <br /> <br />(2) A waiver of the perimeter landscaping requirements. <br /> <br />for the remodeling and expansion of the existing building to become <br />the home of the Discovery Science Center located at 2522 North Main <br />Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. Because of the special circumstances applicable to the <br />subject property, including the property's geometric size, <br />shape, topography, location and surroundings, resulting from <br />the freeway widening and Santiago Creek bed, the strict <br />application of the landscape, setback, and parking require- <br />ments in the zoning regulations would deprive the subject <br />property of privileges not otherwise at variance with the <br />intent and purpose of the provisions of this chapter. <br /> <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights inasmuch as this project, or virtually any other <br />development, would not be feasible without granting the <br />required variances. <br /> <br /> <br />
