105 <br /> <br />GAS: 5/1/~? <br /> <br />RESOLUTION NO. 97-021 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING CONDITIONAL <br />USE PERMIT APPLICATION NO. 97-01, WHICH <br />SOUGHT TO ALLOW THE SALE OF BEER AND <br />WINE FOR OFF-PREMISE CONSUMPTION AT A <br />CHEVRON GAS STATION LOCATED AT 2650 <br />NORTH GRAND AVENUE <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-638 provides for <br />the granting of a conditional use permit from the provisions of the <br />Santa Ana Municipal Code; <br /> <br /> WHEREAS, this Council held a public hearing on April 21, 1997, <br />on Conditional Use Permit Application No. 97-01, which sought to <br />allow the sale of beer and wine for off-premise consumption at a <br />Chevron gas station, located at 2650 North Grand Avenue, Santa Ana; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br /> A. That due to the overconcentration of other establishments <br />licensed to sell alcohol in the area and the proximity of the <br />proposed site to Fairhaven Elementary School, the proposed use will <br />not provide a service or contribute to the general well-being of <br />the local neighborhood and community. <br /> <br /> B. That due to the overconcentration of other establishments <br />licensed to sell alcohol in the area and the proximity of the <br />proposed site to Fairhaven Elementary School, the proposed use will <br />be detrimental to the health, safety, and general welfare of the <br />persons residing, working, and going to school in the vicinity. <br /> <br /> C. That the proposed use will adversely affect the economic <br />stability and future economic development of the property in the <br />surrounding area. <br /> <br /> D. That due to the overconcentration of other establishments <br />licensed to sell alcohol in the area, the proposed use will be <br />contrary to City policy prohibiting establishments from selling <br />alcohol within a 1,000 foot radius of one another. Currently, <br />there are several establishments within 1,000 feet of the proposed <br />site which sell beer and wine for off-site consumption. <br /> <br /> E. That the proposed use will not have an adverse affect on <br />the General Plan. <br /> <br /> <br />
