19 GAS: 1/28/98 RESOLUTION NO. 98- 009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT NO. 97-02, ADOPTING THE MITIGATION MONITORING PROGRAM, FINDINGS OF FACT, AND STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE CIRCULATION ELEMENT OF THE GENERAL PLAN WHEREAS, the Planning Commission, after duly noticed public hearing on January 12, 1998, recommended that the City Council approve General Plan Amendment 97-06, approving the Circulation Element of the City of Santa Ana's General Plan; and WHEREAS, Final Environmental Impact Report No.97-02, State Clearinghouse No. 97071055, dated January 5, 1998, (consisting of documents entitled "Draft Environmental Impact Report No. 97-02, State Clearinghouse No. 97071055," dated October 16, 1997, ~Findings of Fact, and Statement of Overriding Considerations for the Circulation Element," SCH #97071055, dated November 19, 1997, and ~Draft Circulation Element Mitigation Monitoring Program," dated November 19, 1997) (collectively referred to as the "E.I.R.") have been prepared for the Circulation Element of the City of Santa Ana General Plan; and WHEREAS, the California Environmental Quality Act and the State CEQA Guidelines require that, prior to any approval of the Project, the City Council must make certain certifications and findings; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The City Council hereby certifies that the E.I.R. has been completed in compliance with the California Environmental Quality Act, and that the E.I.R. has been presented to the City Council, and that the City Council has reviewed and considered the information contained in the E.I.R. prior to approving the Circulation Element of the General Plan. 2. The findings, statements, and programs set forth in certain documents entitled "Findings of Fact, and Statement of Overriding Considerations," and "Mitigation Monitoring Program," both of which are maintained in the custody and control of the Executive Director of the Planning and Building Agency, or his or her designee, are hereby adopted and approved.
