297 <br /> <br />RESOLUTIONNO. 98- 0 4 4 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA APPROVING USE OF THE PROGRAM ENVIRONMENTAL <br />IMPACT REPORT FOR THE CIRCULATION ELEMENT OF THE CITY <br />OF SANTA ANA GENERAL PLAN FOR THE CONSTRUCTION OF <br />SEVENTEENTH STREET AND LANDSCAPED MEDIANS FROM <br />BRISTOL STREET TO BROADWAY <br /> <br /> WHEREAS, Goal 6 of the Circulation Element of the City of Santa Ana General Plan is to <br />create attractive circulation corridors to enhance the City' s image; and <br /> <br /> WHEREAS, Policy 6.3 of the Circulation Element is to provide landscaped medians on <br />major arterials; and <br /> <br /> WHEREAS, Seventeenth Street is designated in the Circulation Element as a major arterial <br />with a median. <br /> <br /> WHEREAS, Program Environmental Impact Report (EIR) No. 97-02 was prepared in <br />conjunction with the Circulation Element and certified by the City Council of the City of Santa <br />Ana; and <br /> <br /> WHEREAS, the Program EIR provides that, as new activities implementing the goal, <br />policies and objectives of the Circulation Element are approved, if the City of Santa Ana finds that <br />no new impacts would be generated by such activities and that no additional mitigation measures <br />are required beyond those contained in the Program EIR, the City may approve a project through <br />the Program EIR; and <br /> <br /> WHEREAS, section 15168(c)(2) of the State CEQA Guidelines allow the City to approve <br />an activity as being within the scope of a project covered by the Program EIR if no new effects <br />could occur or no new mitigation measures are required; and <br /> <br /> WHEREAS, the City Council has reviewed and considered the all information, testimony <br />and evidence presented, including the findings prepared by the City's Planning and Building <br />Agency, which conclude that the construction and new landscaped medians are activities that are <br />contemplated as part of the implementation of the Circulation Element and that all impacts and <br />mitigation measures, if any, required in conjunction with such activity were addressed in the <br />Program EIR; and <br /> <br /> WHEREAS, the findings and determinations made herein reflect the independent judgment <br />of the City Council. <br /> <br />1 <br /> <br /> <br />
