RESOLUTIONNO. 1999-03 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA SPECIFYING THE FUNDS <br />IN WHICH CERTAIN iMPOUNDED VEHICLE <br />FEES AKE TO BE DEPOSITED <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA HEREBY <br />RESOLVES, DETERMINES, AND DECLARES AS FOLLOWS: <br /> <br /> WHEREAS, the City Council in August of 1998 adopted Resolution <br />No. 98-041 which raised the impound fee charged to drivers whose vehicles are <br />nonconsensually towed due to driving with no license or on a suspended license; <br />and : <br /> <br /> WHEREAS, the prior fee of $62 was retained for all other impounded <br />vehicles but was raised to $125 for tows of such drivers; and <br /> <br /> WHEREAS, the City has received a state grant from the California Office <br />of Traffic Safety which will pay for three sworn officers andnon-sworn personnel <br />to administer a program to increase City effectiveness in preventing vehicles <br />driven by drivers with no license from driving on City streets; and <br /> <br /> WHEREAS, this grant was explicitly made contingent upon the City <br />raising the nonconsensual towing fee as set forth above; and <br /> <br /> WHEREAS, since the City Council's prior action $i00 of this .$.125 fee is <br />set aside to be used to continue this program alter the grant ends, which is a <br />service and benefit to all drivers on City streets including drivers with no or <br />suspended licenses; and <br /> <br /> WHEREAS, the Califomia Office of Traffic Safety has requested formal <br />confirmation from the City Council that the $I00 set aside portion of the unilateral <br />towing fee for vehicles will be used for this special program and not for other, <br />more general purposes; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA, that the fee collected for all unilateral tows of <br />.vehicles impounded because their driver is driving with no license or a suspended <br />license, which has been set by prior action of the City Council at $125.00, shall <br />continue to be divided into the following funds: <br /> <br /> <br />
