113 <br /> <br />RESOLUTION NO. 99- 028 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SANTA ANA DENYING VARIANCES <br /> FROM SEVERAL SECTIONS OF THE SANTA ANA <br /> MUNICIPAL CODE FOR THE RELOCATION OF A <br /> <br />· CHURCH LOCATED AT 2012 SOUTH FLOWER <br /> STREET <br /> <br /> WHEREAS, the applicant is seeking several variances from the <br />Santa Aha Municipal Code Section for the relocation of a church <br />located at 2012 South Flower Street. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY TEE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br />That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location <br />or surroundings, the strict application of the zoning <br />ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of this chapter. <br /> <br />The subject structure was built in 1953 and was in <br />compliance with applicable codes prevailing at that <br />time. However, the building was constructed to <br />accommodate retail and office uses and not parking <br />intensive uses such as a church. As a result, there <br />are no unique or special circumstances applicable to <br />this parcel that would deprive the subject property of <br />privileges enjoyed by other properties constructed for <br />their specific use. <br /> <br />Bo <br /> <br />That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial <br />property rights. <br /> <br />The granting of the variances are necessary for the <br />preservation of property rights as any other permitted <br />use in the community commercial zoning district would <br />need to obtain a variance as the site has been vacant <br />for over a one year time period. As a result, any new <br />use would be required to comply with the City's zoning <br />provisions, including parking, landscaping, setbacks <br />and circulation. <br /> <br /> <br />
