245 <br /> <br />GAS:4/27/99 <br /> <br />RESOLUTION NO. 99-039 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL <br />USE PERMIT NO. 99-08 TO ALLOW PARKING <br />FOR AN ADJACENT COMMERCIAL USE LOCATED <br />AT 2040 SOUTH CYPRESS AVENUE <br /> <br /> WHEREAS, the Planning Commission held a public hearing on <br />April 26, 1999, on Conditional Use Permit Application No. 99-08, <br />to allow parking adjacent to a commercial use located at 2040 <br />South Cypress Avenue. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing, this Council finds and determines as follows: <br /> <br />Will the proposed use provide a service or facility which <br />will contribute to the general well being of the neighborhood <br />or community? <br /> <br />The proposed parking lot for Kely's Auto Body will <br />provide additional parking opportunities for a project <br />that is in an area that currently has a severe parking <br />shortage. Due to the growth in the bus±ness and the <br />physical constraints of the existing si~e, the parking <br />provided no longer meets the needs of the bus~ness <br />located on the premises. <br /> <br />Bo <br /> <br />Will the proposed use under the circumstances of the <br />particular case be detrimental to the health, safety or <br />general welfare of persons residing or working in the <br />vicinity? <br /> <br />The proposed parking lot has been designed to minimize <br />impacts to the surrounding residential uses. For <br />instance, a wall of trees and shrubs are proposed along <br />the north and south property lines, thereby enclosing <br />the parking lot project. In addition, vehicular access <br />is not permitted on Cypress Avenue, which will also <br />minimize adverse impacts. <br /> <br />Will the proposed use <br />stability or future <br />surrounding the area? <br /> <br />adversely affect the present economic <br />economic development of properties <br /> <br />The development of the site with a parking lot will <br />enhance the economic viability of the area as this use <br />will replace a vacant parcel of land that was <br />previously approved for an apartment project. <br /> <br /> <br />
