377 <br /> <br />GAS: 9/16/99 <br /> <br />RESOLUTION NO. 1999-061 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING VARIANCE NO. <br />99-07, SEEKING RELIEF FROM CERTAIN <br />PROVISIONS OF THE SIGN CODE RELATED TO <br />OVERALL HEIGHT, LINEAL FOOTAGE AND SIGN <br />AREA OF A MONUMENT SIGN LOCATED AT 4505 <br />WEST FIRST STREET <br /> <br /> WHEREAS, Santa Aha Municipal Code Section 41-638 provides for <br />the granting of a variance from the provisions of the Santa Aha <br />Municipal Code, upon making certain findings; and <br /> <br /> WHEREAS, this Council held a hearing on September 7, 1999, on <br />Variance Application No. 99-07, seeking relief from the sign code <br />for height, lineal footage and sign area. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br />ao <br /> <br />That because of special circumstances applicable td the <br />subject property, including size, shape, topography, <br />location or surroundings, the strict application of the <br />zoning ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of the Municipal Code. <br /> <br />There are no special circumstances applicable to the <br />property located at 4505 West First Street which, due <br />to the size, shape, topography, location or <br />surroundings, would deprive the property owner of <br />privileges not otherwise at variance with the intent <br />and purpose of the provisions of the Santa Ana <br />Municipal Code. <br /> <br />B o <br /> <br />That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial <br />property rights. <br /> <br />The sign variance is not necessary for the preservation <br />and enjoyment of one or more substantial property <br />rights. The property currently has adequate signage <br />and the applicant is seeking a variance to consolidate <br />the signs into a bigger sign at variance with the code. <br /> <br /> <br />
