5 <br /> <br />RESOLUTION NO. 2000-02 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL <br />USE PERMIT NO. 99-21 TO ALLOW THE <br />TAQUERIA GUADALAJARA RESTAURANT, <br />LOCATED AT 1904 WEST FIRST STREET, TO <br />OPERATE 24 HOURS A DAY <br /> <br /> WHEREAS, Conditional Use Permit No. 99-21 came before the Planning <br />Commission for public hearing on November 8, 1999, to allow the Taqueria Guadalajara <br />restaurant, located 1904 West First Street, Santa Ana, to operate 24 hours a day; and <br /> <br /> WHEREAS, on December 6, 1999, the City Council of the City of Santa Ana set <br />Conditional Use Permit No. 99-21 for public hearing; and <br /> <br /> WHEREAS, following said public hearing, the City Council determined to approve <br />Conditional Use Permit No. 99-21, subject to conditions, based upon the findings. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing, the City Council <br />finds and determines as follows: <br /> <br />Will the proposed use provide a service or facility which will contribute to the <br />general well being of the neighborhood or community? <br /> <br />The extended hours of the restaurant serves the community by providing an <br />eating establishment that is safe and convenient for patrons desiring to dine <br />after midnight. It also serves the community by being a late night gathering <br />place for those residing in the neighborhood. <br /> <br />Will the proposed use under the circumstances of the particular case be <br />detrimental to the health, safety or general welfare of persons residing or working <br />in the vicinity? <br /> <br />Although the area surrounding the restaurant is considered above average <br />in crime, the restaurant employs security guards during the evening hours <br />which has kept specific police related incidents at a minimum at the subject <br />restaurant. It is not anticipated that the extended hours of operation of the <br />restaurant will be detrimental to the health, safety and general welfare of <br />persons residing or working in the area due to the presence of an on-site <br />secudty guard and the conditions that have been placed upon the project by <br /> <br />Resolution No. 2000-02 <br /> Page 1 of 3 <br /> <br /> <br />
