RESOLUTION 2000-040 <br /> <br />REVENUE <br />ACCOUNT <br /> <br />DEPARTMENT/MISCELLANEOUS FEE OR SERVICE UNIT <br /> <br />SECTION IV FIRE DEPARTMENT <br /> <br /> SERVICE STATIONS <br />5546 Flat Fee <br /> <br />Additional Costs: <br /> Add up the quantities of all the various chemicals (or materials) in each of the three <br /> categories (gallons, cubic feet, pounds). Usc thc highest quantity ofcbemicals (or <br /> materials) listed to detcrmine the number range (1,2,3 ...) <br /> <br />Count the number of chemicals (or materials) listed to determine the appropriate <br />range-letter (A,B,C...). <br /> <br />Using the combined Range figures (Number and Letter, I-A, 2-C, etc.) to determine the <br />correct fee from the schedule. <br /> <br />5546 <br /> <br />Late Filing Fee <br /> The Fire Chief shall impose a late filing penalty based on additional administrative <br /> costs incurred due to the late filing of any business plan, eerfification, or inventory. <br /> The amount of such penalty shall be 25% of the fee for such filing. Nonpayment <br /> of the fee and penalty shall incur 10% interest on the amount of the billing starting <br /> 30 days after the date issued, <br /> <br />FY 00-01 <br /> <br />181 <br /> <br />86.00 <br /> <br />5546 <br /> <br />ADMINISTRATIVE PENALTY FEE SCHEDULE <br /> <br />This fee schedule utilizes a base penalty for each of the listed offenses and <br />assesses a surcharge to that penalty expressed as a percentage of the base <br />penalty for those factors outlined in H&S Code section 25514.5(0 which <br />include but are not limited to the following considerations, but shall not <br />exceed $5,000 for each day the violation occurs: <br /> <br />a. Ext~nt of harm caused by thc violation - surcharge to 500 percent. <br />b. The nature and persistence of the violation - surcharge to 500 percent. <br />c. The length of time over which the violation occurs-surcharge to 100 percent. <br />d. The frequency of past violations - surcharge to 100 percent. <br />e. Action taken to mitigate the violation - surcharge to 100 percent. <br />f. Financial burden on the viola~r - will be considered. <br /> <br />The following base penalties shall be assessed for the below-listed violations: <br /> <br />I. H&S Coda Section 25503.5 <br /> Failure to establish and implement a business plan for <br /> emergency response. <br /> <br />2. H&S Code Section 25503.6 <br /> Failure to notify real property owner that a business plan is <br /> required. <br /> <br />3.
