<br />and from W. C. Porter, 1237 C~en Place. On motic~ of Councilman Harvey,

<br />Mr. Heinly stated that substantial rights were being denied this property
<br />owner, citing other applications approved in the area such as the tailor shop
<br />and barber shop, and submitted pictures of the establishments and perking
<br />required of them and of subject property. On motion of Couuc~lma~ Gilmore,
<br />seconded by Council,m- Harvey ~ carried, Council received and ordered filed
<br />the pictures.

<br />Ralph Seedy, 1306 Glenwood Place and Mrs. Florence Forrest spoke in oppositien
<br />to the gr~nting of the variance. The pl~,~ Director explained that the
<br />pl~n~ing C.-~-.-ission felt there were no special hardships to the property, that
<br />80% of the lot would be used for parking, noted it would be combined use of
<br />residential and liquor store use, and that under the Municipal Code~ a sign
<br />3~ feet high could be built. There being no further testimony, the hearing
<br />was closed.

<br />City Council uphold the decision of the Pls~t~E C~,=aiasio~ and instruct the
<br />City Attorney to prepere a resol'.,tion denying Variance 1851. On roll call

<br />The Clerk reported that notice of the hearing was given by the Planning Depart-
<br />ment with evidence on file, and that no written c..--..~ications or objections
<br />had been received.

<br />Council heard James Rourke, ~00 N. ~ondway, attorney representing the
<br />applicant, cite traffic on McFadden as inccmrpatible with residential usage;
<br />and noted public facilities such as sewer and water ~es were larger than
<br />for multi-f~m~y develol~aent within two blocks. A plan of the pro~ect sub-
<br />mitted to the Council was received an~ ordered filed o~ motion of Ccyancilm~
<br />Schlueter, seconded by Counc~ma~ Gilmore and carrie~.

<br />Stone, 1117 W. McFadden appeared in opposition to the variance. There be~
<br />no further testimony, the hearing was closed.

<br />On motion of Counc~-mn Harvey, seconded by Counci~-m~ Schlueter and carried,
<br />Council upheld the decision of the Zoning Administrator and instructed the
<br />City Attorney to prepare a resolutien denying Variance 18~8.
