RESOLUTION NO. 2001-025 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AUTHORIZING THE CITY OF SANTA ANA TO <br />ENTER INTO AGREEMENTS PROVIDING FOR <br />PARTICIPATION IN THE CALIFORNIA FRANCHISE TAX <br />BOARD'S TEST PILOT PROGRAM FOR BUSINESS <br />LICENSE REPORTING <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby, finds, determines <br />and declares as follows: <br /> <br />California Revenue and Taxation Code § 19556 mandated that cities <br />report certain business license information to the State in order to identify <br />self-employed individuals who were not filing required income tax returns. <br />City of Santa Aha ("City") employed the services of MBIA Muniservices to <br />provide the required information to the Franchise Tax Board. <br /> <br />The legislation was repealed effective July 1999. Following the repeal, <br />California eliminated funding from the State Budget that went to cities for <br />providing the business license information. <br /> <br />The 2000/2001 California State budget appropriated funds for the <br />Franchise Tax Board to conduct a pilot program to contract with cities to <br />provide business license information to the State. The City of Santa Ana <br />was selected to participate in the pilot program. <br /> <br />Participation in the pilot program requires that the City provide the State <br />with a copy of a resolution of the local governing body which by law has <br />the authority to enter into the pilot program. <br /> <br />City shall contract with MBIA Muniservices to provide business license <br />information to the Franchise Tax Board on behalf of the City. <br /> <br /> Section 2. The City Manager, or his designee, is authorized to enter into <br />agreements providing for the participation in the California Franchise Tax Board's Test <br />Pilot Program for business tax reporting. <br /> <br /> Section 3. Appoint the City Manager, or his designee, as agent for the City of <br />Santa Ana to conduct all negotiations, execute and submit all documents, including but <br />not limited to applications, agreements, amendments and payment requests which may <br />be necessary for the completion of the aforementioned agreement. <br /> <br />Resolution No. 2001-025 <br /> Page 1 of 2 <br /> <br /> <br />
