RESOLUTION NO. 2001-039 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA EXTENDING PREVIOUSLY APPROVED <br />CONDITIONAL USE PERMIT NO. 99-06 BY ONE YEAR <br />FOR A DRIVE THROUGH LANE LOCATED AT 1700-1720 <br />EAST DYER ROAD <br /> <br /> WHEREAS, the Planning Commission approved Conditional Use Permit No. 99-06 <br />to allow a drive through service lane at 1700-1720 East Dyer Road in conjunction with <br />two other discretionary actions: 1) Conditional Use Permit No. 99-07 to allow a service <br />station; and 2) Tentative Parcel Map to subdivide the westerly parcel into two (service <br />station and parking lot), after public hearing on April 12, 1999; <br /> <br /> WHEREAS, the Planning Commission granted a modification to Conditional Use <br />Permit 99-07 on October 9, 2000 for modifications to the site plan and elevations. <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-647 provides that Conditional <br />Use Permit No. 99-06 shall automatically become void after two years from the effective <br />date of its approval if the owner fails to institute an action to erect, build, alter move or <br />maintain the use of the property as specified in said conditional use permit; <br /> <br /> WHEREAS, Santa Ana Municipal Code Section 41-647 allows the City Council to <br />extend the date on which Conditional Use Permit No. 99-06 becomes void by one <br />additional year; and <br /> <br /> WHEREAS, the applicant requests a one year extension for Conditional Use <br />Permit No. 99-06. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Conditional Use Permit No. 99-06 is hereby extended one additional year from <br />the date on which it would have automatically become void, as conditioned in Attachment <br />"A," attached hereto and incorporated herein. <br /> <br />ADOPTED this 18TM day of June, 2001. <br /> <br />ATTEST: <br /> <br />Patricia E.
