~C, ,P, AG~: NO <br /> RESOLUTION NO. 2002-071 ~. ~/~ , <br /> TIME: ~1: ~ OM <br />A RESOLUTION APPROVING THE SUMMARY VACATION <br />OF AN L-SHAPED ALLEY SOUTH OF HALESWORTH <br />STREET AND WEST OF BROADWAY STREET <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />The City of Santa Ana intends to vacate an L-shaped alley south of <br />Halesworth Street and west of Broadway Street, pursuant to and in <br />accordance with the provisions of Chapter 3 of Part 3 of Division 9 of the <br />Streets and Highways Code of the State of California. <br /> <br />The vacation of said alley is a summary vacation because the alley lies <br />within property under one ownership pursuant to the provisions of section <br />8334 of the Streets and Highway Code of the State of California. All <br />properties adjacent to said alley are owned in fee by the El Sol Academy. <br />This vacation is needed for a lot line adjustment for further development of <br />El Sol Academy. <br /> <br />The alley to be vacated has been impassable for vehicular travel for a <br />period of five consecutive years and no public money has been expended <br />on said alley during this time. Further, the alley is not necessary for traffic <br />circulation. <br /> <br />Do <br /> <br />The alley to be vacated contains three in-place public utility facilities <br />(Edison, Pacific Bell, and Adelphia Cable Communication) that would be <br />affected by the vacation therefore, the utility companies have requested <br />easements. <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br />project is exempt from further review. Categorical Exemption ER No. <br />2002-300 will be filed for this report. <br /> <br /> Section 2. The City Council of the City of Santa Ana hereby approves the <br />summary vacation of the L-shaped alley south of Halesworth Street and west of <br />Broadway Street, as more particularly described in Exhibit A hereto, which is <br />incorporated herein by reference. <br /> <br /> Section 3. <br />recorded. <br /> <br />The above alley shall not be deemed vacated until this resolution is <br /> <br />Resolution No. 2002-071 <br /> Page 1 of 3 <br /> <br /> <br />
