EEARING - APPEAL 133 Mayor Hall opened the he&ring on Appeal <br />BEAR STATE B~L~RS, INC. 133 filed by Bear State Builders, <br /> from the Plamuimg Commission's denial <br /> of Variance Application 1974 to construct <br />a l0 ~mit apartment that proposes parking a~d maneuvering ia street side yar~ <br />at 1136 W. 2md Street. Cou~c~lm-- ~A~bard was disqualified from discussion a~d <br />action in this matter because of a comflict of interest, amd left the Council <br />table. <br /> <br />Tbs Clerk reported that notice of the hearimg was mailed to property owmers <br />on August 10, 1964 as required by law, and tha% no cemmmmications had been <br />received. There being no response to the Mayor's call for testimony, the <br />hearing was closed. <br /> <br />Steve Lafer, City Senior Planner, stated that the appellant had agreed to <br />work out design solution, but had not returned with revised plans. Mayor <br />Hall called to Council's attention other buildings nearby with reduced side <br />yard~. <br /> <br />On motion of Councilman Gilmore, seconded by Counc~lm=n Schlueter and carried, <br />Council overruled the action of the Planning Commission and instructed the <br />Ci.$y Attorney to prepare a resolution granting Variance 1974, subject to <br />applicable conditions.
