RESOLUTION NO. 2002-109 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING CONDITIONAL USE PERMIT <br />NO. 2002-29 AS CONDITIONED FOR THE PROPERTY <br />LOCATED AT 812 NORTH SYCAMORE STREET <br /> <br />Kdo/12/11/02 <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />Conditional Use Permit No. 2002-29 came before the City Council of the <br />City of Santa Ana for a public hearing December 16, 2002. <br /> <br />Conditional Use Permit No. 2002-29 has been filed with the City of Santa <br />Ana seeking to construct a five-level parking structure within the <br />Civic/Professional District of the Midtown Specific Plan (SP3) District. A <br />conditional use permit is required to construct a parking structure in the <br />Midtown Specific Plan area. <br /> <br />The Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on December 9, 2002, on Conditional Use Permit No. 2002- <br />29, and voted by a vote of 7:0 that the City Council approve Conditional Use <br />Permit No. 2002-29. <br /> <br />Santa Ana Municipal Code Section 41-638 authorizes the City Council to <br />grant a conditional use permit upon making certain findings. <br /> <br />That the granting of a Conditional Use Permit is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights. <br /> <br />The proposed parking structure will provide an additional <br />service to the community by increasing the parking available <br />to residents and visitors from the surrounding area. <br /> <br />Resolution No. 2002-109 <br /> Page 1 of 6 <br /> <br /> <br />
